Bosch Reverses Earlier Denial and Concedes Use of Nucap's Brake Component Drawings; Court Orders Expedited Discovery and Sets Hearing for Nucap's Preliminary Injunction Motion
Nucap is continuing to vigorously prosecute its claims against Robert Bosch LLC and Bosch Brake Components LLC. Nucap claims that Bosch misused Nucap's confidential and proprietary brake component drawings to qualify inferior replacement component suppliers, and asserts claims including trade secret misappropriation and copyright infringement.
In a reversal of Bosch's earlier claim that it had not used Nucap's drawings, Bosch now concedes that it used Nucap's drawings in connection with qualifying replacement supplier components. On January 29, 2016, Nucap moved for a preliminary injunction enjoining Bosch from further disclosing or using Nucap's drawings and from purchasing, importing, distributing, and selling brake pads manufactured from components supplied by replacement component suppliers.
On February 5, 2016, Judge Gottschall set a hearing on Nucap's motion for a preliminary injunction for April 12, 2016. The Court also ordered Bosch to produce copies of comparisons of replacement supplier drawings to Nucap's drawings, as well as communications with replacement suppliers.
The litigation is pending in the United States District Court for the Northern District of Illinois and styled Nucap Industries, et al. v. Robert Bosch LLC, et al., Case No. 1:15-cv-02207 (N.D. Ill.)
